What is Third-Party Insurance?

Third-party insurance is a legal requirement for all motor vehicles operating on Indian roads. In simple terms, it protects the vehicle owner (referred to as the first party) from liabilities arising from damage or injury caused to another person or their property (the third party). The insurance company, also known as the second party, takes on the financial responsibility of compensating the third party on behalf of the vehicle owner.

The primary goal of third-party insurance is to offer protection against legal and financial repercussions when your vehicle causes harm to others. It is not designed to cover your personal losses or vehicle damages, but rather those suffered by the third party.

What Does Third-Party Insurance Cover?

1. Personal Injury to Third Party:

If your vehicle is involved in an accident that causes bodily injury, disability, or even death to a third party, the insurance provider will pay compensation as decided by the Motor Accident Claims Tribunal. This is a crucial feature, as medical costs and compensation claims can run into lakhs of rupees.

2. Property Damage:

Third-party insurance also covers the cost of repairs or replacement in case of damage to someone else’s vehicle, building, boundary wall, or other personal property. The insurer will compensate the third party for the losses sustained due to your insured vehicle’s involvement.

3. Legal Liability:

In case a lawsuit is filed against you by the injured party, the policy provides legal liability coverage. It helps you manage court proceedings, legal fees, and settlements arising from the accident.

4. Unlimited Liability in Case of Death or Injury:

There is no upper cap on compensation in the event of death or bodily injury of the third party. The amount is decided by the court or tribunal based on the severity of the accident.

What’s Not Covered Under Third-Party Insurance?

While third-party insurance fulfills legal obligations and offers a basic safety net, it does not provide full coverage. Here are some key exclusions to be aware of:

1. Own Vehicle Damage:

The policy does not pay for any damage caused to your own vehicle during an accident. If you want to cover repairs or the total loss of your car, you need to opt for a comprehensive plan.

2. Injuries to the Policyholder:

Medical expenses, disability, or death of the policyholder are not covered. Separate personal accident cover is required to safeguard yourself financially.

3. Driving Under the Influence:

Accidents caused while driving under the influence of alcohol or drugs are not eligible for a claim.

4. Invalid Driving License:

If the driver does not have a valid driving license at the time of the accident, the insurance claim will be rejected.

Moreover, having this policy ensures that vehicle owners do not face severe financial setbacks due to unexpected liabilities. How to File a Third-Party Insurance Claim?

In the event of an accident, the following steps must be followed to file a third-party insurance claim:

  1. Inform the Insurance Company: Immediately notify your insurer about the accident and provide details.
  2. File an FIR: Lodge a First Information Report (FIR) at the nearest police station. A copy of the FIR is crucial for claim processing.
  3. Submit the Claim: Provide the insurer with the FIR copy, vehicle documents, insurance policy, and claim form.
  4. Survey and Verification: The insurer appoints a surveyor to assess the damage and verify the claim details.
  5. Claim Settlement: Based on the surveyor’s report, the insurer processes and settles the claim amount.

Whether you’re buying a new vehicle or continuing with your existing one, it is essential to renew your car insurance policy before it expires. Timely renewal ensures you remain compliant with the law and continuously protected against third-party liabilities. Many insurers now offer online renewal facilities that are quick, paperless, and easy to complete.
